End User License Agreement (EULA)

Effective Date: May 2, 2025

This End User License Agreement ("Agreement") is a legal agreement between you and TrailMix Technologies Inc. ("TrailMix", "we", "us", or "our") and governs your use of the Eh! mobile application (the “App”), distributed via the Apple App Store. By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

1. License Grant

TrailMix grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Eh! app solely for your personal, non-commercial or organizational use, subject to this Agreement and the App Store Terms of Service.

2. Restrictions

You may not:

  • Copy, modify, reverse engineer, decompile, or disassemble the App;

  • Use the App for unlawful purposes or to promote harmful content;

  • Rent, lease, lend, sell, or sublicense the App;

  • Access or use the App to build a similar or competing product or service.

3. User Content and Conduct

You retain ownership of content you post on Eh!, but by posting, you grant TrailMix a worldwide, royalty-free, non-exclusive license to use, display, distribute, and reproduce that content to operate and improve the App.

You agree not to post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable or in violation of our Community Guidelines.

4. Privacy

Your use of the App is also governed by our Privacy Policy, which outlines how we collect, use, and safeguard your personal information. By using the App, you consent to the practices described in the Privacy Policy.

5. In-App Purchases

The App may offer optional features, digital goods, or subscriptions for purchase via the App Store. All billing is managed by Apple, and any issues must be addressed through Apple support.

6. Updates and Availability

We may update the App periodically, and these updates may be automatically applied. We do not guarantee uninterrupted access to the App, and we reserve the right to suspend or terminate access at any time.

7. Termination

We reserve the right to terminate or suspend your access to the App without notice if you violate this Agreement, our Community Guidelines, or applicable law. Upon termination, your right to use the App will cease immediately.

8. Intellectual Property

All rights, title, and interest in and to the App (excluding user-generated content) are the exclusive property of TrailMix Technologies Inc. and its licensors. No rights are granted to you except as expressly stated in this Agreement.

9. Disclaimer of Warranty

The App is provided "as is" and "as available" without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, TrailMix will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or data arising from your use of the App.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts in British Columbia.
